The operating rules for using Midna as a professional SaaS product for quiz flows, qualification journeys and lead capture.

Acceptance of Terms

These Terms of Service govern your access to and use of Midna. By creating an account, accessing the application or using the service, you agree to these terms.

If you use Midna on behalf of a company or organization, you confirm that you have authority to accept these terms on its behalf. If you do not agree, you must not use the service.

Description of the Service

Midna is a SaaS product for designing visual quiz flows, qualification journeys, lead capture experiences, audience segmentation and commercial follow-up actions.

The service may include a flow builder, public quiz pages, embedded quizzes, themes, workspace management, lead records, webhooks, API access, integrations, billing tools and related analytics.

User Accounts

You may need an account to use Midna. You are responsible for providing accurate information, keeping your credentials secure and controlling access to your workspace.

Midna supports email and password authentication as well as Google and Microsoft OAuth. You are responsible for all activity that occurs under your account or workspace, except where caused by Midna's own breach of these terms.

Acceptable Use

You must not use Midna for unlawful, deceptive, abusive, harmful or infringing activities. You must not attempt to disrupt the service, bypass security controls, access another workspace without permission or extract data in a way that harms the platform.

You are responsible for ensuring that quizzes, lead capture forms, messages, automations and integrations you create comply with applicable laws, including privacy, consumer protection, marketing and anti-spam rules.

Intellectual Property

Midna, including its product design, interface, software, brand, documentation and underlying technology, is owned by Methylene Consulting or its licensors and is protected by intellectual property laws.

These terms do not transfer ownership of Midna to you. Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable right to use the service for your professional purposes.

User Content

You retain ownership of the content and data you submit to Midna, including quiz content, brand assets, lead data, responses, copy, images and workspace configuration.

You grant Midna the rights necessary to host, process, transmit, display and back up your content solely for the purpose of providing, securing and improving the service.

You represent that you have the necessary rights and permissions to upload and process any user content or personal data through Midna.

Service Availability

We aim to provide a reliable and professional service, but Midna is provided on an as-available basis. Maintenance, upgrades, incidents, third-party outages or events outside our control may affect availability.

We may modify, suspend or discontinue parts of the service where necessary, including for security, legal, operational or product reasons.

Limitation of Liability

To the maximum extent permitted by applicable law, Midna and Methylene Consulting will not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, goodwill, data or business opportunities.

Midna is a tool for qualification and workflow design. You remain responsible for commercial decisions, legal compliance, customer communication and the use of any leads or insights generated through the service.

Termination

You may stop using Midna at any time. We may suspend or terminate access if you breach these terms, create security risk, fail to pay applicable fees or use the service in a way that may harm Midna, other users or third parties.

After termination, access to your workspace may be disabled. Certain records may be retained where required for legal, accounting, security or legitimate operational reasons.

Changes to the Service

We may improve, update or change Midna over time. We will try to avoid changes that materially reduce core functionality without notice, but the product may evolve as part of normal SaaS development.

We may also update these terms. The latest version will be published on this page, and continued use of the service after an update means you accept the revised terms.

Governing Law

These Terms of Service are governed by French law, without regard to conflict of law rules.

Where legally permitted, disputes relating to these terms or the service will be submitted to the competent French courts.
